1. Introduction
Welcome to FLUENCY FOUNTAIN™ ("Fluency Fountain," "we," "our," or "us").
These Terms & Conditions govern the purchase and use of our online English coaching services, including one-on-one lessons, group lessons, learning packages, educational materials, and related services.
By purchasing, booking, or attending any lesson, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
2. Eligibility
Our services are available to students worldwide.
Students under the age of 18 must have the consent of a parent or legal guardian. A parent or guardian who purchases lessons for a minor accepts these Terms & Conditions on behalf of the student.
3. Services Provided
Fluency Fountain provides English language coaching and educational services through online platforms.
Lesson formats may include:
One-on-one lessons
Group lessons
Coaching programs
Learning packages
Supplementary learning materials
We reserve the right to modify lesson content, teaching methods, instructors, schedules, and materials when reasonably necessary.
4. Lesson Packages and Validity
Unless otherwise stated in writing, lesson packages remain valid for ninety (90) days from the date of payment.
Unused lessons will expire automatically after the validity period.
Extensions may be granted at our sole discretion and are not guaranteed.
Lesson packages are non-transferable and may not be sold, shared, transferred, or assigned to another person without our prior written approval.
5. Scheduling and Rescheduling
In principle, any request to change a scheduled lesson time must be submitted through our designated Customer Service channels at least twelve (12) hours before the scheduled lesson start time.
Requests submitted less than twelve (12) hours before the scheduled lesson start time may be declined.
Repeated cancellations or excessive rescheduling may affect future booking priority.
6. Attendance and No-Show Policy
Students are responsible for arriving on time.
Late arrivals, absences, or requests to end a lesson early will be treated as completed sessions and will not be eligible for refunds, credits, or replacement lessons.
Students who join a lesson late may use the remaining lesson time.
7. Student Responsibilities
Students agree to:
Maintain respectful communication with instructors and staff.
Attend lessons prepared and on time.
Ensure access to a stable internet connection and suitable device.
Use lessons and materials only for personal educational purposes.
Refrain from harassment, abusive language, discrimination, or disruptive conduct.
8. Parent and Guardian Responsibilities
Parents or legal guardians purchasing lessons for minors are responsible for:
Providing accurate information.
Supervising minors when appropriate.
Ensuring compliance with these Terms & Conditions.
Providing consent for lesson participation and recording where applicable.
9. Privacy and Recording Policy
Students may provide personal information necessary for lesson administration and service improvement.
We will collect, store, and process personal information in accordance with applicable laws and reasonable business practices.
Lessons may be audio or video recorded for purposes including:
Quality assurance
Teacher training
Service improvement
Dispute resolution
Recordings will be handled confidentially and accessed only when reasonably necessary.
10. Intellectual Property
All lesson materials, documents, worksheets, presentations, recordings, and educational content provided by Fluency Fountain remain the intellectual property of their respective owners.
Students may not:
Reproduce
Distribute
Publish
Sell
Share
Record
Screen-record
any lesson materials or recordings without prior written permission.
11. Conduct and Right to Refuse Service
Fluency Fountain maintains a respectful learning environment.
We reserve the right, at our reasonable discretion, to suspend or terminate a student's lessons immediately if the student engages in:
Harassment
Threatening behavior
Verbal abuse
Discrimination
Fraudulent activity
Repeated disruption of lessons
Any conduct that negatively affects instructors, staff, or other students
Such conduct constitutes a material breach of these Terms & Conditions.
In the event of such a breach, Fluency Fountain may terminate the student's current course and all remaining lessons immediately. Any unused lessons remaining in the student's account shall be forfeited and shall not be eligible for refund, credit, or compensation.
12. Service Quality and Course Reports
If a lesson is significantly disrupted due to instructor-related issues, including instructor absence, excessive lateness, or technical problems under our control, students may submit a Course Report through Customer Service within seven (7) days of the incident.
Failure to submit a report within this period will be deemed acceptance of the lesson as delivered.
We will review and respond to Course Reports within three (3) business days whenever reasonably possible.
13. Compensation for Instructor Faults
If instructor-related issues, including instructor absence, excessive lateness, or technical problems under our control, result in the loss of one-third (1/3) or more of the scheduled lesson duration, Fluency Fountain will issue one (1) complimentary replacement lesson of the same type and duration.
The replacement lesson shall carry the same validity period as the original lesson package.
If the same instructor incurs instructor-related faults affecting more than five (5) lessons within the same calendar year, the student may request a refund of the remaining unused balance through the Course Report system.
14. Refund Policy
Refunds are available only in the circumstances expressly described in these Terms & Conditions or where required by applicable law.
Approved refunds will be returned to the original payment method whenever possible.
Refunds will generally be processed within seven (7) days after approval.
Any fees charged by third-party payment providers, banks, or payment processors may remain the responsibility of the student.
15. Technology Disclaimer
Students are responsible for maintaining a suitable internet connection, device, software, and learning environment.
Fluency Fountain is not responsible for lesson interruptions caused by:
Student internet failures
Device malfunctions
Power outages affecting the student
Third-party platform outages beyond our reasonable control
16. Results Disclaimer
Fluency Fountain provides educational coaching and language learning support.
We do not guarantee specific outcomes, language proficiency levels, examination scores, academic performance, employment opportunities, immigration results, or any other measurable result.
Learning outcomes depend on many factors, including attendance, participation, practice, effort, prior knowledge, and individual circumstances.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Fluency Fountain shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of our services.
Our total liability relating to any claim shall not exceed the amount actually paid by the student for the affected services.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
18. Force Majeure
Fluency Fountain shall not be liable for delays, interruptions, or inability to perform services due to events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, government actions, widespread internet outages, pandemics, or other force majeure events.
If normal operations cannot reasonably resume within thirty (30) days after such an event, students may request a refund of the unused portion of their lesson package through Customer Service.
19. Changes to These Terms
We may update these Terms & Conditions from time to time.
Updated versions will become effective upon publication on our website or other reasonable notice to students.
Continued use of our services after such updates constitutes acceptance of the revised Terms & Conditions.
20. Contact Information
Questions, concerns, Course Reports, and other service-related requests may be submitted through our official Customer Service channels.
While students may contact us through various social media platforms, our designated Customer Service channels remain the primary method for support and dispute resolution.
We will make reasonable efforts to respond during normal business hours.
21. Governing Law and Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law principles.
In the event of any dispute arising out of or relating to these Terms & Conditions or the use of our services, both parties agree to first attempt to resolve the matter through good-faith negotiation.
If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to the courts of Taiwan having appropriate jurisdiction, unless otherwise required by applicable law.
